We need to remind people of Trump's extremist position each and every day. It is not only the right thing to do, it's politically smart. When even OHIO voted to protect a woman's freedom to control her own body ... and did so TWICE in 2023 ... it pointed the way.
A renewed debate about the need for an Equal Rights Amendment might focus public attention on the fact that every woman’s right to life, liberty and health was effectively curtailed by Dobbs. These are fundamental civil rights. Roe allowed state restriction on abortion after fetal viability. Dobbs allows states to deny fundamental civil rights to pregnant women always.
Roe allowed state restrictions on abortion before viability.
The basic trimester scheme. The first trimester: only basic regulations of medicine such as abortions can be limited to physicians. Second trimester: more regulations of the procedure. Third: Ban allowed with a maternal health/life exception.
Planned Parenthood v. Casey allowed more regulations. Some include waiting periods, parental notification/consent laws (with some bypass), limits on specific procedures, etc.
I just read that one of the studies relied on by Judge K in the mifepristone case has been withdrawn as faulty. Do you think that will have any effect on the Extremes?
A problem with Dobbs is it giving an equal protection argument for reproductive liberty the back of its hand. The ERA is an intriguing prospect. But, if the Supreme Court is going to have such a restrictive view of equal protection, it is of limited value as a concept, perhaps.
The text of the ERA is broader than the Equal Protection Clause. This is often not discussed. The ERA proponents often have a more open-ended view of equality, a more active view. A post-WWII modern constitutionalism view that is not merely negative in nature.
I think it can be a model to equal protection and rights in general.
From what I’ve read, the ERA finally was ratified by the required number of States, but time had run out. The current Congress certainly seems not to inclined to extend that time limit (perhaps it was 25 years?). The ERA is not in effect at this time.
Yes. When proposed, Congress put a time limit & then extended it. That ran out too around 1980. Unlike some amendments, the time limit was not in the amendment itself.
Three states recently "ratified" it but (though some argue the time limit was unconstitutional) it didn't count. At least there was no official recognition.
Some Democrats (and Lisa Murkowski; don't know about Collins) in Congress support Congress lifting the time limit but it didn't pass when they tried it. There was some testimony about the amendment during this campaign. The breadth of the text was not really covered much from what I can tell.
Medical decisions should not made by the government, full fucking stop. This is why I'm an anarchist. No one should rule over anyone else, ever. Not to mention that all governments are AUTHORITARIAN. The path the wealthy control freaks are leading us down is horrific. Wealthy, white men have installed conservative idiot, yes they are all idiots, judges and hired pro forced birth attorneys to control and torture women. They won't stop with a 16 week abortion ban either. They are coming for birth control, IVF treatments, fetal anomaly detection. They want to force women to carry non viable pregnancies to term🤬 Think I'm being alarmist...
I cannot even enjoy reading about the lastest scientific discoveries because wealthy white men have decided women aren't people but livestock.
You lost all credibility when you said this ,” Trump wants credit for overturning Roe v. Wade — but doesn’t want to be blamed for the pain it has caused for…….*****women and other pregnant people*****. Please stop with the gaslighting, Americans have had enough of it. Only women can become pregnant.
And now we have the Alabama Supreme Court ruling that even fertilized - not “yet” implanted - embryos are persons. They will allow a wrongful death action to proceed against another patient who accidentally dropped an destroyed someone else’s frozen embryos. They’re not just going for heartbeat. It’s from the moment of fertilization?
Republicans have demonstrated that they are incapable of denying the Christian Nationalist wing of their party anything it wants. Combined with Trump's intent to govern by executive order and disregard for rule of law, if Republicans win the election this country will be unrecognizable in 2025. Voters are not being adequately warned, and I don't think the Democratic party is taking this election anywhere near seriously enough.
Testifying. Amen brothers and sisters. Ending the national abortion ban will take a village effort. People get ready there's a train a-coming You don't need no baggage you just get on board... by The Impressions.

Point taken. What Dobbs overturned was the protection of a pregnant woman’s civil rights vis-a-vis abortion that remained.
Let’s remind Mr. Trump, that even though he likes even numbers, 4 months is actually a tad over 17 weeks, not 16. What a crackpot.

A comment references the Equal Rights Amendment.

Women aren't livestock. Livestock get treated better. To them women are birthing appliances, a thing, not a being.
That's a fair yet chilling assessment 😬

Bye, Mae. I don’t need credibility from you.
Maybe a credible and basic biology course would help you out, then?

Chris,

Right on, Chris! You are absolutely correct—the anties won’t stop unless we make them with votes.
oof, I read the title as "an abortion" instead of "on abortion" and yeah, wow, that's my cue to sleep.
Great read, as always
