If Trump (or any other Republican for that matter) wins, it IS the end of democracy in the United States. At least unless and until the regime is dislodged. Because the Republicans have made it very clear that they are going to restrict all rights, both human and civil, and govern by edict through the executive branch. They're not even particularly trying to hide it. They think Americans will choose their fascism over the incumbent Democratic administration. And if the election were held today, they'd probably be right. This is a sorry state of affairs, poised to be one of the biggest crisis periods in world history. What a time to have to (try to) live through.

Chris, I’m worried that we’re already past a tipping point on the effectiveness of our critical institutions. Honestly, I’m still reeling from the Mueller Report that was Bill Barred! SCOTUS has ethical problems. I see racism and discrimination everywhere. Has our country been handed over to Trump like the Germany business leaders did for Hitler? Help! I’m so worried. Alyce

tRump per se isn't the threat...he's no more than an aging, cognitive-challenged narcissist front-man who can rally mobs. It's the people behind him, the puppeteers, who are the real dangers. Once the "Project 2025" crowd have gained the presidency, it's over, folks. No, tRump is not a Hitler, he himself is too wasted and intellectually bereft to be a guiding force to whom all shall just "follow orders"...other will give the orders, tRump's rôle is that of a spray-tanned Paul von Hindenburg, ready to hand the keys of government to a tRumpian "chancellor", whence policy decisions will flow. And what a supporting cast is being assembled for tRump 2.0...jesus bloody christ.

This. This is what's missing in the common public discourse.

Trump is already attempting to lay the groundwork to say the election was rigged if he doesn’t prevail.

In this case extreme measures should be taken so as to avoid another 1/6!

My most pressing concern regarding that scenario is; Is the FBI, HSA, & top military brass paying attention?? Are they ready for Insurrection 2.0??

Sometime in 2023, there was a 60 Minutes (I think) episode where they were discussing the problem of maga & qanon believers in the military & what the military was doing about it.

The answer was….not enough & not fast enough. That is very problematic.

Agree, we are in quite a quandary. I keep working and sharing, hoping it sticks!

This is tough, the whole measure ot it. I would hope that the government is ready for anything Trump threatens to throw at us. And he will if he loses.

In a shameless decision denying women the right to control their own bodies, what was once 'our' Supreme Court became a Republican Judiciary. Coupled with the apparent favoritism shown in accepting specious pleas, the majority have clearly shown themselves to be a political tool rather than an independent Judiciary.

Those of us who have retired will not suffer to the degree of our children and theirs, but the fascist wolf is at our door and has not even bothered to wear sheep's clothing.

Chris,

I want to compliment you today for your amazing court reporting on not just the specifics of one case rather the specifics of the entire judicial branch of our government today. Existentially Trump as 47 would end our three co-equal branches of government envisioned by the founders and aspired by each of us today. Espousing a model of Executive dictatorial equities superior to both congressional and judicial branches our founders created and we enjoy at this moment. He says the quiet part outloud. Thank you for all you do for your readers and subscribers. We are in this together. Roll Tide.

Before Biden, I'd never voted in a Presidential election before, even though I'm over 35. In 2016, I thought it'd be amusing if Trump were elected - maybe he could shake things up - although I didn't actually vote for him. I sat on the sidelines. After seeing the carnage he brought to the office, the disrespect, his wife destroying the rose garden, "grab her by the pu**y", his firing of the pandemic response team to save money, his constant lying, and the Republican stacking of the supreme court, I was disgusted. I knew I had to act. I voted for Biden in 2020 and for the 2024 election I will do the same.

I’m glad you finally saw the light & voted. Every vote does count. I had to chew my 48 yr old nephew’s ass to push him to vote for the 1st time in 2020!!! I couldn’t believe it. I told him if he didn’t get registered & vote then I never, ever wanted to hear him complain about anything going wrong in this country again. Voting isn’t just a privilege, it is also a responsibility.

Just look at what has happened to women’s rights to their own bodies, laws passed all over making it harder for the working poor & minorities to access the vote, & Affirmative Action thrown in the trash. It’s horrible & may get a lot worse if we don’t win & then push Biden to expand the scotus.

If the '24 senate map wasn't so horrific, we could at least hold on to hope that the senate could be a roadblock to further MAGAFYING the court but there is simply no way that democrats can hold the senate if Trump wins the white house. I'm still holding on to the hope we could still have Speaker Jeffries in that scenario.

...but six months is a long time, especially in politics and when both candidates are around 80 years old.

I firmly believe that we can pick up Colin Allred over Ted Cruz in Texas, & Ruben Gallegos over Kari Lake in AZ.

I presume we will lose Manchin’s seat to a Republican. What do you think about our chances of keeping Sherrod Brown & Jon Testor?

I understand Jacky Rosen in NV is up for grabs & of course we need to keep it, but I’m having a hard time donating to her campaign after I heard about her voting NO on Biden’s Federal judge appointment who comes from a Middle Eastern background & I assume is perhaps Muslim. That really makes me angry because I feel that she is discriminating.

This is concerning to say the least.

The courts are undoubtedly the worst part of it; but it's also up to the pro-confederacy fascists in the US Senate who have the power to block any actual Jurist that Biden might dare appoint or that his people would even suggest to him. To me that's the true horror of the USA, rather than appointing persons that know the Law - a dwindling number as is - they're chosen on the basis of, can they be "confirmed".

Chris, this is an excellent article on many levels. I’m curious if your research included identifying the roll FEDSOC and Leonard Leo played in appointing any federal judges in the time after FEDSOC was created in the early 1980’s.

Expand full comment

They & Leo are completely involved in all Republican appointments to the Federal Courts, also in getting state AGs & Solicitors General elected. They are involved in getting State Judges appointed & then re-elected to their positions. If you haven’t already done so, look up the podcast On The Media & listen to the 3 episodes titled

We Don’t Talk About Leonard. I just went to my podcast app & could only find Episodes 1 & 2, so you may have to look on YouTube or go to their website to locate #3.

A multi-billionaire recently left Leo about 2.6B to distribute among various dark money orgs to be spent on continuing that work of getting very conservative Christian people into positions of power in the 7 Mountains of Society…..Dominionism.
