And I totally agree with Justice Jackson — this shadow decision signals to lower courts its already-formed prejudices.

This is horrible and exposes trans folk being outed at every turn. As a Canadian trans woman, I use my passport for more than simply crossing borders. My driver’s license and passport are often used at banking institutions, lawyers offices and government buildings to confirm my identity for reasons other than confirming my gender. Thus, in each circumstance I will be outed as trans even when this fact is not relevant to the particular situation. It’s demeaning and can cause undue embarrassment or possible danger if some psycho happens to see the documents. Further, I am quite sure Mr. Trump would not like to have his actual weight emblazoned on all of his identification documents.

Trans people … children of immigrants … indefensible acts against those with little defense.

If the president and politicians had as much courage as trans people, immigrants and minorities, there would be a lot more getting done than there is. All minorities are living in a hostile world presently and should be commended for their courage unlike the cowardly politicians.

And the bitterly ironic thing is that they are, in fact, a real minority—the white, racist, bigoted elite dispensing edicts for the many who find this needless … and heartless.

How are law schools going to teach people about the standards for injunctions? Whenever Trump is involved, all standard practices go out the window.

The present Supreme Court is corrupt. They aren’t interpreting the law, but making it. They are ignoring their oath. One of the first thing that the Democrats need to do when they take power is increase the number of Justices, establish ethics and standards which are enforceable, and impeach the Justices already on the bench who have blatantly broken the law. That can’t happen soon enough!

As long as SCOTUS deals with rules and procedures, it can avoid dealing with actual people … those nasty things outside their precious gates.

Also quite evident—this Court no longer respects the findings of its lower courts. I guess the law is black-and-white after all. And that justice isn’t a matter of colorblindness … but tunnel vision.

I believe Germany or some other European country recently enacted a law allowing any resident to change their sex on identity documents at will. That’s not a complete solution, but does nicely bypass much of what the transgender folks are unhappy about.

For a small percentage of the population, sexuality is a very complicated subject that will never be handled well by those insisting that there are just two sexes.

“Displaying passport holders’ sex at birth no more offends equal protection principles than displaying their country of birth—in both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment.“

Tell that to the 6 million Jews who died in the Holocaust.

The "decision" is specious and ignores the potential consequences. My grandson (who has traveled abroad) now will need to be careful where he travels. Even "safe" countries have people who would use the contrast between his lived gender and what is on his passport as an excuse for abuse or unlawful detentions. I doubt that he would travel out of country under those circumstances, but it is a grotesque abuse of both executive and judicial powers to allow this intrusion into his private life. I hope I live long enough to see Trump & Company gone, and three members of the Supreme Court replaced, by whatever means, including old age. I don't like wishing death on anyone, even people as distorted as this group, but that is essentially what they are doing to people I care about.

Hmm, is it any wonder that the conservatives on the Court - one-third of which have credible sexual misconduct complaints - and a conservative administration - the leader of which has been found to have committed a forced sexual assault - prefer gender clarification … for future assaults?

I don't believe Gorsuch would write anything resembling the Bostock opinion today. That was before the Republican Party decided to go all in on the trans panic. It's clear now that the conservative majority will not stand in the way of any discriminatory policy related to trans people.

It appears to me that not only have Trump and MAGA lost any credibility but the Supreme Court has joined them.

What has already happened to the USA and is continuing, even worsening under Trump is appalling, sickening, obnoxious, frightening and indisputably so.

Finally, I have to wonder whether this decision is a trade-off for the Court having to slap Trump’s wrist on tariffs?

So this is the final word? All trans individuals are stuck with passports that show their sex at birth?

Laura Belin's avatar

It's not the final word. But it means trans people will be stuck with these passports as the litigation continues. It could be years before SCOTUS finally issues a ruling on the merits.

Vicious, evil, corrupt, vile, contemptible, inconceivable, devoid of reason, unthinking, uncaring, hate-filled, bilge... That is what truly vomits from this mediocre excuse for a Court - Like a Grand Wizard of the KKK, Roberts rules over this Supreme Court of Cultists, deigning to look down on the lowly beasts who come before them, begging the Court to hear their cases and to judge with the impartiality their power demands, using the wisdom of Solomon, and blending in their empathy, compassion, and authority of the government to improve the lives of their fellow humans... These poor poor saps have no fucking idea that none of these robed bastards are empathetic to their plights, as they have been bought and paid for a long time ago and any vestiges of humanity or empathy that any of them had possessed is long gone by now, leaving only bitterness, greed, and bloated, rotting corpses, like zombies with one distinct difference - these zombies are after our very souls instead of our brains... After all, each of these people already have the brains to be where they are, they just lost their hearts and souls to greed and ambition too many damned years ago to even remember anymore...
