After some press pass restrictions were blocked, the Pentagon adopted an "interim policy" with similar restrictions. Also: The latest on the Trump admin's mandatory detention policy.
After over a year of this, the usual practice should be sanctions or at least the general conclusion that an order alone isn't enough. They will try to find a way around it or simply violate it.
Over and over again, call in people to explain. Make special efforts to ensure compliance. Require status reports upfront. (Some district court judge was called out for requiring a senior official to do this, and it was bulls---) And whatever else they can do.
The lawyers who signed this pleading are Brett Shumate, Sarah Welch, Joseph Borson, and Michael Bruns. Shumate has signed off on a ton of these absurd pleadings. Welch only recently came into the case. I'm pretty sure I've seen Borson on other pleadings for DOJ.
I agree with your assessment. Plaintiffs should move to depose everyone connected with the interim policy, and provide the information to the Court seeking sanctions and suggesting referral for discipline. The Court should file sua sponte an order to show cause directed at the lawyers to determine if they violated Rule 11.
yeah, I’m really glad federal judges are holding the line on individual scuffles, but when is one of them actually going to paint the bigger picture of insurrection and seditious conspiracy, at least something a little more broadly damaging than “no”? The courts can't keep pretending these cases are all unrelated coincidences; they're trying to dismantle the Constitution
Wotta administration! The Pentagon tries an end-run on a court order to control the flow of information (a sure sign that its war on Iran is not going swimmingly); the DoJ ignores not only court orders but now a Congressional subpoena.
If the MAGA Supremes allow Steve Bannon to skip his Congressional subpoena, a legally binding command, what are the chances anyone at DOD ever testifies? I'm guessing 0 chance. And even if they did? 5th Amendment time or complete obfuscation. Everyone in tRump administration, including tRump, swore an oath to the Constitution. Problem is that none ever read it! (Or maybe they're just thinking outside the box?)
I fear you’re right. In the movie “Judgement at Nuremberg” counsel for the Nazis made much of how they borrowed from U.S. eugenics theory … now we’re borrowing back it seems.
Administration violates order. Judge angry. Rinse/repeat.

Looking forward to the Home Stretch panel.
NO ONE on the Fifth Circuit wanted rehearing en banc? How do you figure? Waste of time?

¯\_(ツ)_/¯

Thank you Chris for the DOD court information and looking forward to Home Stretch.
