It seems to me that if and when this case is settled and especially if the decision is to allow the TRO , couldn’t Gov Kotek then call the national guard to protect the protesters FROM those ICE m’fers? That’s the way they were used during the civil rights movement, right? Why in gods name shouldn’t every city being besieged like this use the guard to monitor those brown shirts. Not to necessarily confront them, but to be a presence and a witness. It just seems like that is the answer to Orange Mussolini’s federal meddling.
This is a very similar scenario but here the state vs federal roles of LEOS and the NG are flipped.
What's identical is the obvious need to protect civilians from out of control armed government agents, state in civil rights days, federal now.
There are situations where the only appropriate course of action is to place the appropriate armed forces who are true to their oaths as a buffer between citizens and another armed force willing to violate theirs.
Using state national guard to resist federal forces probably constitutes insurrection and would lend justification to the Executive involving the Insurrection Act.
I don't disagree about the outcome, but I'm not 100% convinced that would constitute an insurrection. It's a scenario that, thankfully, has never needed to be addressed.
At least the Insurrection Act -- unlike martial law -- doesn't touch the supremacy of the judiciary. And if this circumstance arises, I still believe there are only a few judges with the audacity to ignore the preponderance of the evidence and find in Trump's favor.
I’m aware of cases during the Civil Rights movement when the President federalized the National Guard to protect students trying to integrate or marchers, because local officials refused to do so or were part of the instigators. But I haven’t heard of states calling up there NG to protect protesters and victims from federal mistreatment. They would probably get federalized pretty quickly. Maybe state militia who are separate from NG, if available? I don’t know much about those.
Relatedly, and interestingly, the regime’s application to stay the 7th circuit order blocking NG deployment in Chicago has now been fully briefed and pending decision for a week.
I would assume if the 9 th circuit rules against McDonald trump, they will appeal to his SC maga law firm and it will be overturned-I would almost guarantee it -
