It would interest me to read an account of how justices not named Alito and Thomas spend their time as a comparison. I think one or more probably warrant more attention but for now would just like more attention given to them. I have seen limited analysis but am interested in more from major media.

Why on earth are these students filing a case in front of this judge? Let students in another part of the state get the ban enjoined!

No one who wants a decent LGBT-friendly ruling should be filing federal cases in the Amarillo division.

Still, prospective litigants and lawyers alike should do everything in their power to avoid setting up this judge to rule on culture war issues. Eschew the drag fundraiser for this year while other circuits are establishing the law on drag shows, for example.

I suppose the countervailing consideration is that if you can draw an unsustainably bad decision from him, the Fifth Circuit will rein him in. Seems like a bad gamble to me, but YMMV.

As a Texas resident, the mere mention of Kacsmaryk's name makes my blood boil. Why on earth do we have him on the bench if he's just going to be overturned every time? Talk about a waste of taxpayer money and of resources.

You have him on the bench because a substantial majority of people in your state voted for the presidential candidate who promised to put people like this on the bench. I'm sure you didn't, but a whole lot of people, including neighbors and possibly friends, did. This is the consequence, and because it's a lifetime appointment, it's a consequence that will be visited on Texans for decades to come.

The people who put him there don't care if he gets reversed. To them, that just shows the need to elect a president who will appoint more people like him to the Fifth Circuit.

So he can keep making his bs rulings and maybe some of them actually sway other judges. That's basically the point to delay, to waste money, and to sway others.
