At least seven judges have blocked invasive administrative subpoenas targeting gender-affirming care for minors, so DOJ appears to be trying a new tactic to get the info it wants.
I deleted an anti-trans comment. Anyone is free to write at their own space if they want to do so, but you are not going to use my comments to spread anti-trans commentary.
Forum shopping is the modus operandi for this Administration. Not a proper forum? That does not matter if you can find a judge who knows nothing and cares less about trans people. Personal prejudice is a terrible thing in a judge when it gets in the way of actually considering facts and law. Some of these Republican judges don’t need any facts presented and subject to challenge.
It's important to keep in mind that this is not just the Trump DOJ seeking to prevent gender-related care to minors and their families. It's the White Christian nationalists (e.g. the Heritage Foundation) who seek to impose their perverted religious beliefs on the entire nation.
Thanks to the courts these horrible intrusions into people's lives aren't being given free rein. What's wrong with these people! Everyone not just like them has a target on their backs! How awful it must be to wake up every day hating everything that's not just like your "perfect" yourself!
As a UK lawyer I am both astonished and dismayed by courts colluding with this misuse of ex parte applications. My limited knowledge of US law leads me to believe that it is not that far away from ours ie to be used only in cases of extreme urgency, or where informing the respondent would defeat the object of the order sought, and requires full disclosure by the applicant of any information or legal precedent/legislation which would run counter to the order being granted.
Typical UK cases are where it’s believed that a respondent is about to abduct a child or imminently destroy/dispose of disputed property. When orders are granted they are in terms which are the least restrictive required to prevent the harm alleged, and with a requirement for a swift “return date” at which the respondent can reply, having been served not just with the order but all the supporting evidence and documentation.
There is no apparent urgency in these cases, and the idea that the respondents are required to comply with orders to disclose patient records before they or those patients are able to respond or even (if I understand this correctly) see the material upon which the orders were granted is preposterous. Surely such (il)legal sleight of hand should result in disbarment. That judges are colluding in this is appalling. Clearly the “Wild West” is not limited to cowboy movies.
A trot through CoPilot informed me, I think, that a convening a grand jury does NOT require any nexus between the place where it is convened and the place where the investigation is focused: here, a question about a Rhode Island hospital's treatment of kids. A SUIT based on the grand jury's findings has to be brought with proper jurisdiction and venue, but not the actual grand jury.
Is this true? If so, can Congress change that by legislation? And can a RI judge quash a subpoena from a TX grand jury with no nexus if there is no obvious lying by the US attorney's office?
Not asking for legal advice, but trying to crowdsource ideas on what patients & parents can do (if anything) who aren’t in Langone network but are almost certain their own hospital was also served in same criminal subpoena. If the hospitals won’t disclose to their patients and families, do they just have to wait it out until something is unsealed?
I saw a class-action lawsuit was filed in Maryland last week against the admin subpoenas, is this an option for criminal? Children’s medical records are the most sensitive of all - this speaks to a much broader issue of medical ethics and privacy concerns. It’s hugely concerning and yet the general public doesn’t seem to care because it’s “trans kids” and also a political third rail. It’s all so frustrating and deeply upsetting.
Wrong. Kids are FAR more knowledgeable about their own gender than you believe. I knew I was a girl from a VERY young age even though I was forced to live as a boy and didn't transition until my 40's. And as a result I lived an entire life in a state of depression. I was misdiagnosed several times and it wasn't until the last time I tried to take my own life that I realized I had to transition or I would not survive.
What people like you do is make assumptions based on your own lives but you cannot conceive of any other way. Gender identity is FAR more complicated than determining what's between your legs and gender identity is hardwired in the brain. Condemning transgender children to go through puberty is CRUELTY and forces them to accept a body that does not conform to their own internal wiring.
That is why trans kids are only allowed puberty blockers. Surgery is not an option for trans kids until they reach 18 years old and the idea that "millions" of children are being "mutilated" is nothing but a flat-out lie.
I know you will completely reject what I'm saying because that is what people like you do. But thanks to Trump's anti-trans agenda and the reduction of gender affirming care for youth, the risk for suicide has more than doubled.
The data is clear: gender affirming care is LIFE SAVING CARE. If you actually cared about children you would SUPPORT gender affirming care, not reject it.
They aren't concerned about the suicide rate or depression for kids who have lived your experience. I would suggest it brings them joy to read it. Most of these chuds are just afraid of discovering/admitting an attraction to a trans person (by accident) because questions of manhood blah blah blah.
I'm glad you're finding your way and hope that you can/have found the joy buried deep inside you that was held back for so long.
I came out when I thought society had matured enough that we would be accepted. That was true when Obama was in office. Then Trump got elected and everything has gone to shit.

Good. And consider blocking the person, too.
Misinformation, misrepresentation, just plain lies … this administration soils everything it touches.
Excellent decision in the end. And a timely reminder that for every O'Connor there's a McElroy, and we can't give up.

I’d like the hospital to reply “no such records exist. We do not need perform ‘sex rejecting’ procedures “.
A disgusting and terrify attack on vulnerable patients and their privacy rights. Judge shopping (to Texas of course) should be banned.

Are there any public records of the 12 May hearing? I love to read a tongue lashing.

You should not have had to go through the pain you did, but I'm glad you were able to find your true self.
