Kavanaugh stops would always be bad. As a tool in the Trump administration's authoritarianism arsenal, they are worse. The consequences are everywhere.
J Kavanaugh's appended note to his concurrence in *Trump v Illinois* was all about closing the barn door after the horse bolted, as ICE/CBP have taken his *Perdomo* opinion as "controlling", and went about promptly to abuse the shit out of it. I don't know what "shadow docket" case will eventually reach SCOTUS in which not only Kavanaugh, but maybe one or two other hard-liners can see the criminal folly of the *Perdomo* decision, and radically pare back the flagrantly unconstitutional street seizures and house-breaking snatches of a largely protected class of immigrants whose status is under court review, and whose 4th and 5th Amendment rights are summarily ignored routinely.
Worse yet, the sheer number of habeas petitioners are crushing the federal district court work-loads, as so much time is taken up not by judges' time spent in adjudication, but by constant and systematic flouting of those stays and TROs by DOJ/DHS, either through incompetence, deliberate stalling, or simply lying and misrepresenting to the court regarding compliance. Clearly, the Steve Bannon prescriptive "flood the zone" strategy has long since been extended to "flood the courts", as arrests, transfers to out-of-state concentration camps, and even deportation continue at scale whilst the courts desperately try to keep up to stem the tide, in what to date is a losing battle against regime law-breaking. Hard to see when this will end, if at all, unless massive changes in Congress will bring in committed oversight, with teeth!
What’s particularly striking is that these conservative six - an African American, an Italian, an Irish, Catholics all - who should have memories of past discrimination, delight to discriminate for themselves.
Now that I understand the scope of the Epstein-Trump network, I have to wonder what Kompromat they have on Kavanaugh. He’s a drinker; I don’t doubt he is capable of much worse—we saw that temper at his hearings…He is not a man of integrity.
Hey Justice I like beer- what happened to a citizen only experiencing a minor inconvenience? Does jailed days without due process, chemical burns, broken windows, stolen cell phones, misplaced wallets sound like a minor inconvenience?
Who pays for their medical bills, their broken windshields, their new cell phones?
The government? Do they get reimbursed? Do they cover the sick days?
How about the funerals ? Where’s the justice for Renee Good? Pretti? Who answers for those citizens murdered for YOUR Kavanaugh rule?
YOU made racial profiling legal and put a target on every single human being in this country.
"[A]s for stops of those individuals who are legally in the country, the questioning in those circumstances is typically brief, and those individuals may promptly go free after ..." really, kavanaugh? it doesn't matter <how long> the stops are- they violate the constitution by taking place at all.
"As with my prior requests at 50 and 100 days, I have heard nothing from the justice. If I do hear from Kavanaugh, I will let you know."
Chris, please don't hold your breath waiting . . . we need you!!!
Meanwhile, seems like it's time for protesters to start wearing masks. Trump and his minions will use every tool, including DOGE's stolen data, to target protesters.
Joni Ernst tells me that we should respect the law, for our nation’s security, while people are being snatched off of the streets by a lawless kakistocracy. She seems to think that this is an acceptable position, so much so that she sent me two identical emails, it is NOT.
PLEASE CALL your elected disappointments and tell them what you expect from them, this is UNACCEPTABLE and inhumane. Being undocumented is not a criminal offense and companies should not be profiting from this lawless behavior.
If only it were a Kavanaugh stop. These are Kavanaugh sweeps. His Leave It To Beaver frozen-in-amber world view of “policing” where encounters end with “you have a nice day now, you hear?” would be funny if not so tragic.
I read the entire ruling in the Kavanaugh stop decision and even at the time, his description of what would happen versus what was actually happening was preposterous
I for one thank you from the bottom of my heart for bringing this up with SCOTUS three times now. Kavanaugh will go down as another Justice who was appointed to protect our country from exactly the abuses Trump and his thugs commit every damn day. They have failed our country horribly. I have also written to the SCOTUS Public Relations office and encourage everyone to do so.
When this is all over (hopefully "when", not "if"), we'll have to revisit the scope of DHS - that post-9/11 abomination.
In particular, we need to revisit the size of the CPB's "near the border or coast" buffer zone. Right now, it's 100 miles. It includes all of NJ, DE, FL, MI, nearly all of the New England states and much of NY and PA. Interestingly, it doesn't include Minneapolis - I'm curious how CPB gets it's power there.
We should also examine whether the CBP permanent inland inspection stations make sense. Why should every vehicle on I-10 heading from El Paso get quizzed about it's occupants' citizenship and checked with drug sniffing dogs (there are perhaps another half dozen of these "inland border crossings" in Texas alone).
But the first thing that should be done is move the immigration courts out of the executive, migrating them to be an Article 3 court system

The old "pull up the ladder" business, plus perhaps a little bit of self-hatred in another Justice.
Exactly right! And after all, didn’t he paste a target on Justice Sotomayor’s back? (“Not so far, Ms. Lat-tee-nah!”)
Now that I understand the scope of the Epstein-Trump network, I have to wonder what Kompromat they have on Kavanaugh. He’s a drinker; I don’t doubt he is capable of much worse—we saw that temper at his hearings…He is not a man of integrity.
After Christine Blasey Ford’s testimony do we really need to ask?
I’ll have to find that! Thanks—Kavanaugh’s is like every mean, slimey, alcoholic attorney that entered my mother’s bar.
No need for [scary foreign word], man. Kavanaugh simply agrees with the Trump administration's priorities.
And who paid off his debts? What scum
I have a fantasy where Kavanaugh wakes up one morning with dark skin and a foreign accent.
One can always dream.
a modern gregor samsa, if you will.
A cockroach by any other name.

You are a POS.
Kavanaugh won’t say diddly squat about his abominable Kavanaugh stop.
I've heard that he hates hearing it called that, so we should use it as often as possible.
Yes, absolutely!
ICE and CBP never (Kavanaugh) stop to think … much less care.
"[A]s for stops of those individuals who are legally in the country, the questioning in those circumstances is typically brief, and those individuals may promptly go free after ..." really, kavanaugh? it doesn't matter <how long> the stops are- they violate the constitution by taking place at all.
Party Boy doesn't have to explain himself to you. Or the parties. Or lower courts.

"Your papers please" with an American drawl instead of a clipped German accent.
