It’s too bad Manji is getting screwed but it’s also too bad that they can’t slot someone else in there pronto. We’ll see how long Grassley maintains blue slips or how long he’s around.
(And, I think this is laid out much more directly and clearly to explain the stakes and causes — rather than just giving you a number that is going to be misinterpreted.)
I must say my eyes went kind of buggy trying to read through this thoroughly detailed and researched Substack post. No wonder the average plebeian feels disconnected from our government. The judicial branch is quite complicated. Thank you for being a knowledgeable set of eyes on the inner workings of our democracy.
I don't have a firm opinion on blue slips for district court nominees, but as far as I am aware none of the people who have been calling for an end to blue slips have acknowledged the fact that it will ensure that we start getting judges like Kacsmaryk appointed in blue states. It's true that may happen anyway, but it's not certain it will happen.
I agree with you on blue slips. One Fifth Circuit advocate well known on Twitter/Bluesky was upset at the number of Fifth Circuit district vacancies. He argued it was important for Democrats to place good trial judges there when they had the ability to do so.
Four appellate judges would be less upsetting when we know for sure the two will not take senior status. I grant I'm greedy on the judge in the heavily Democratic circuit.
The other nominee is (as you say) lousy -- why couldn't the damn Dem dissenters realize NOW they should stop opposing him on specious grounds?! -- and an important slot. They should have replaced him when they had the chance.
Central District, Eastern District, and Northern District. Blue slips benefit Republican senators too by giving them power over judicial nominees. Also, Democrats can make it harder to confirm district judges if the Republican play hardball. Still, we have a reason to doubt the staying power of the promise.
I hope President Biden can seat All his judges before this next administration?! You've written a terrific article this evening and will reStack ASAP 💯👍

Chuck Grassley as you suggest is a tad old -- he's over 90.
I don't understand the Judicial System in the USA today.. Put everything in terms I can understand or leave me alone...
You ... subscribe to Law Dork.

Thank you Chris. This is the
only breakdown of the
Judiciary appointments and
methods this lame duck
session I've seen.
Thanks for the breakdown.

I'm confused. Why would Grassley want to help Democrats block someone? Also, what do C.D., E.D. and N.D. in the parentheticals mean?
