That LGBTQ ruling is a bleak situation, indeed. A rule years in the making with careful input, hearings, and crafting is vacated by one crank with a robe.

it wasn't supposed to be years in the making - it was a "we'll do this emphatically year 1" promise from the biden team during transition, and they already had the language for it. the admin actually even tried to get out of doing a PPACA 1557 trans healthcare nondiscrimination rule at all, pushing it back by a year, each year, until ultimately telling us they'd do it next term (lol). natl lgbtq orgs pressured them into it but in the process signed off on a 1557 actively worse than naked statute + bostock. the judicial and cultural landscape would have been completely different if they'd actually engaged in rulemaking on the timeline and with the values they'd initially committed to. i've been doing this for a decade and i've never worked with a dem executive branch as fickle as this one on lgbtq policy at any level of government, and that includes john bel edwards's if you can believe it.

Probably only happened because of the leaked phone call between Trump & Alito. MSM is dying, but this shows the importance of a strong independent media. Going to be a long, bumpy ride. Refuse to kneel!

I've heard all the legalistic blibbidy-blab justifications so spare me, but I still find is shocking that a single district judge could have or even claim the authority to issue a ruling covering the entire country. If he'd issued a ruling saying the Title IX changes couldn't be enforced in the Eastern District of TN Northern Division, sure. I wouldn't agree with it, but yeah, he'd have the authority. But the whole nation?

There are 94 districts in the federal court system and as it stands, any single judge in any one of those districts can wipe out any federal rule that arises in a suit, at the VERY least delaying its implementation across years of appeals including in any district where the rule would have been approved by the federal court located there. Despite the "But"s and the "You have to understand"s, I still say that's screwed up and Congress should start taking seriously its power to regulate lower courts.

Except, of course, I expect SCOTUS would declare any such move unconstitutional. :-\

or "You misunderstood what I

was saying." And give Trump

all this hate for anyone who is

different than an idealized

version of perfection. Gay,

lesbian, have been around for

thousands of years.

Transgender have been

around, openly, for close to

a hundred years. They are all

human beings endowed, from

birth, with the right to love

and happiness. Leave them

alone! They aren't hurting you!

Kavanaugh pretended that the country was obviously glad about the Nixon pardon. Gorsuch made out that we shouldn't care about Trump himself but the future of the presidency when talking about the immunity decision. Their votes are somewhat unsurprising if dead wrong.

It is ridiculous that even this order had to have a caveat that suggests the result was a close question. For now, a bit of justice -- Trump will be sentenced as a convicted felon, one bit of his repeated election interference having some sort of consequence.
