What I particularly like about this piece and others of yours that you write, is they are a reminder that Trump is only one part of the problem...we have serious issues in Congress, and in the states.
I also believe that SC Smith's filing leaned in to J. Coney Barrett's commentary in trump v US, when she allowed that organizing a fake electors scheme would clearly be an "unofficial act", and I also believe that Coney Barrett will side with the three dissenting Justices in upholding the bulk of Smith's charges should they reach Scotus, and furthermore that J Kavanaugh may join for a 5-4 majority.
If tRump loses, even "Mr Immunity" himself, CJ Roberts, may as well be persuaded to cross over...even the self-righteous can read the room.

Chris, question for you: if Trump loses the election, when the immunity case makes its way back to SCOTUS, do you think they will be less inclined to hear the case at all? My thinking is that Trump's handlers will have no particular use for him anymore, and will therefore not put much effort into protecting him. Do you think that's likely, or just wishful thinking on my part?
I honestly think it depends. In that scenario, I think it makes a difference what happens post-election, how the case makes its way to them, and what the broader landscape looks like. The men don't like this prosecution; that is pretty clear. The question is whether things change enough that Barrett and her thinking can control where the case goes. Smith clearly is banking on it, quoting her repeatedly.
As for not taking it, I just don't see how you get there. Thomas, Alito, and Kavanaugh aren't letting it drop. They just need one more vote for cert, and Gorsuch is likely almost as sure a vote as them.
... and I hope that Governor Abbott, the pro-life Catholic, will finally see his way to write "Stop -clemency granted' on one of the two executions set 10/17 (simultaneously) in Texas (Robert Roberson) and Alabama, after ducking the "innocent" claim of Marcellus Williams this week. What a farce. We have a week plus to write in and get him to change his mind. God help us all. I feel bad for pro-life Texans.
