This is particularly insidious given the damage Trump-appointed Postmaster General Louis DeJoy has done to the postal service delivery time, especially for rural areas. Thanks for keeping us informed on this, Chris. I live in Oregon, where we vote 100% by mail and have since the late 1990s. Originally ballots had to be received by Election Day but a more recent law change allows them to be counted if they are postmarked by Election Day, so this will affect my state. Fortunately we also have ballot drop boxes at libraries and government offices but I live in Portland. I’m sure people in rural areas here have fewer options.

This has an echo from the 2020 election and POS tRump demanding "Stop the count!" at promptly midnight Election Day, when he had a clear EV win. Didn't work then, nor will such obvious chicanery work now, 5th CA "Gang of Three" not withstanding.

Trump’s real campaign only starts after the voting stops. We all know that if he loses the vote, he will campaign non-stop (24/7) to throw out votes, stop vote counting, repeatedly claiming rampant voter fraud, filing lawsuits, campaigning to get election boards and legislatures to delay or deny certification of the election results until Jan 20, 2025. If he can do that, the House of Representatives is then tasked with selecting who will be president.

Can't wait for November, and for all these to be over. Can't wait to celebrate Kamala's victory wearing this "Kamala removes stubborn orange stains" t-shirt 👇 🤣

I remember hearing a discussion on the podcast "More Perfect" about how the Baker v. Carr case lead up to Bush v. Gore, and set a dangerous precedent BUT that the upside was that the Supreme Court ever since kept the system working and protected rights.

Now... now I see how naive people were about the integrity of the court to uphold true justice and rights in our country. We've finally reached that danger point, where the Supreme Court would turn into a purely partisan political puppet, having granted themselves the right to rule on partisan cases. I wonder sometimes if even getting someone like Harris elected can fix this problem. I like to hope so, but in the years since Trump first took office we've seen nonstop how vulnerable our country's judicial system really was all along.

When Obergefell was decided, my friends all danced and praised and said "We did it! We have true rights now!" and I remember saying "Great, now we need to pass federal laws to solidify those rights." And people just looked at me confused and said "Why? We won." I think after Dobbs they figured out why.

The footnote - even as it's only referring to the fifth circuit - is nonetheless interesting. I remember how bad we all thought Bush was. Not to defend him (obviously he appointed Son of Sam (although he wanted Harriet Miers) and his father appointed Thomas) but just to note how much worse it's gotten. If you could go back twenty years and show people then what the future held. Sigh.

I'm a little bit skeptical of judicial manipulation. I also believe that there was a frozen NBA lottery draft envelope that told then Commissioner David Stern to pick it out so the Knicks could draft #1 and get Patrick Ewing :-)
