The targeted hospitals and medical staff of these subpoenas better vigorously fight against the subpoenas, and go to court for this invasion of medical privacy laws. This radical right-wing regime has no right directing their personal hatred of trans persons to intimidate and harass people, and to prevent trans medical care. What would right-wing fanatics do if a federal administration forced all humans born with a penis to undergo mandatory vasectomies? I bet they'd call that massive overreach of their privacy. So is dictating that lawmakers and administrations can forbid trans care, and women's right to their own reproductive organs care. The ERA needs to be revised, and passed, with a provision that no lawmaking body in the US can enact any law regarding medical care in the US. That only a physician or medical provider with a patient can decide medical care.

I am so exhausted and disgusted by the never ending scapegoating of transgender people—but it’s especially pernicious to go after children. I can’t imagine anything good coming from allowing the Trump Administration access to anyone’s medical records.

It’s interesting (horrifying) that items 11 and 12 in the appendix do not specify that the information should relate to minor patients. The data being requested almost certainly includes minor patients who are now adults. I’d guess some adults may have also initiated their care at CHOP in their adulthood, despite it being a children’s hospital, because there are often limited resources to receive gender affirming care elsewhere.

CHOP’s argument challenging the subpoena is weak… Trauma to patients is hardly the worst part, and unfortunately can’t be expected to garner sympathy these days. The federal government is seeking to compile a list of transgender Americans. Let that sink in.

What's the likelihood the DOJ will drag its feet, provide nothing useful, and move to enforce the subpoenas anyway? Are there any consequences they can fear?

Thank goodness these have been challenged. There is no justification for going after this information, but so many organizations are just rolling over for Trump I was afraid there wouldn't be one hospital willing to say No.

I realized, rather dizzyingly, that the only reason that this order doesn't directly impact a family member is that this family member moved out of state less than 100 days before the dates covered by subpoena, and was not receiving care on or after 1/1/2020.

Feeling a metaphorical bullet whiz by your head that closely is... really something.

The point is to terrify. Fucking scum. So much for “medical freedom.”

Make sure to excoriate and ostracize everyone in your life (if any still exist) who supports this Nazi garbage. No, they’re not “coming back.” They’re lost, they’re supporting omnicide, so fucking punish them. Hard. You know, something that matches the fact that via carbon-flooring alone they will destroy your children’s future.

Concentrate on getting nonvoting non-Trumpers on board.

It's unclear to me how a WA judge could assert jurisdiction over a MA hospital. The ox purportedy being gored is in someone else's field.

The case isn't being heard in WA and involves no WA folk or institutions. Why does Judge Butynski have any say in the proceedings?
