She might be the only appellate Republican appointee in D.C. willing to do so regularly these days, but the D.C. Circuit judge has kept it up — for whatever branch needs it.
Welcome back. Nice work tying together the need for reason to prevail with the recognition that each person must find their route to elevate that reason. Thank you.
Brava, Judge Henderson … but fingers in the dike, I fear—as you note, the six conservatives on the Supreme Court seem content to watch the quickening river pass by.
Touché, Judge Henderson. The judge just showed the Supreme Court radical how to apply the law, the Constitution and properly weigh the merits of the parties. Justice Roberts and Coney-Barrett should be embarrassed by this ruling - which, unfortunately, leads me to believe they will, out of spite, overturn it on appeal.
Meanwhile, thank you, Chris for returning the frontlines of the Battle for Democracy!
The opinion reads to me as if Henderson is telling John Roberts and the Fash Five to man up or admit that they aren't a court, just one of Trump's tools.
First of all, welcome back and glad vacation was good. Second, hear you on the whole frog thing.
And no matter what SCOTUS does, judges, lawyers, even regular joes and janes without a JD have to remind SCOTUS that the law matters. That the separation of powers matters. That the Constitution matters.
Every time a judge rules on the law, it is a point of shame to SCOTUS. And this matters.
Thank you. This is so heartening on an ugly day. And yes: everything we do—no matter how small—matters. We’re a bucket brigade: rest when you must, friends, but rejoin the line and make small efforts big.

But, better with Judge Henderson than without even as we face fingers in the dike.
Absolutely!
Thank You. It is good to see
there are still some republicans
who understand their OATH!

I have always had mixed feelings about Judge Henderson, but no more. She is a mensch.
