I'm not a lawyer, but I'm pretty sure filing a false report is a felony (say, reporting that a prisoner had tried to commit suicide when, I fact, it was a homicide resulting from the actions of his captors). When are we going to start to see arrests and trials?

A. Takes place

B. Is delayed indefinitely by a presidential declaration of national emergency

C. Voided by presidential declaration that it was fixed to benefit Democrats

D. Rendered meaningless by terrorist, i.e. ICE, Border Patrol, Proud Boys, Oath Keepers, activity around blue precinct voting places

E. Be conducted and counted in a Putin-like manner with the outcome predetermined

the republic will likely be in tatters.

The Kerr analysis is as thoughtful and generous to DHS/ICE as anyone, apart from the Supreme Court, is going to be, and Kerr concludes that the Administration has an argument (that administrative warrants allow home entry, abduction and detention), but that it isn't very sound. We are in this for the long, long haul folks; all of the powers of the state, save for the initial judicial functions of the US federal district courts, are in the hands of predatory and vengeance filled actors, whose willingness to contort the law is only matched by their belief that the Supreme Court which they paid for will eventually come through for them.

I support deportations. I support ICE. I support President Trump’s agenda. What I do not support is lazy lawyering dressed up as executive power. A deportation order is not a battering ram. It’s an administrative finding. The idea that it magically converts into a Fourth-Amendment-free search warrant is insane — and unnecessary. Federal magistrate judges exist for a reason. If ICE wants to kick a door, get a warrant. It takes hours, not weeks. When the government cuts corners, it loses moral authority, hands wins to activist judges, and risks poisoning otherwise lawful enforcement. You don’t need to break the Constitution to enforce it.

Thanks for this post; it is buoying to know that a conservative understands that this excess serves no real American's purpose. Adherence to the rule of law, and the sometimes tedious -- but rights protective -- processes serve every American, every citizen, and every person here on our soil.

ICE is making no distinction among undocumented aliens, legal residents, those awaiting or even attending asylum hearings, and citizens. If they look Hispanic, speak Spanish or even English with an accent, work at low paying jobs, or in the vicinity of any of the above, per Kavanaugh’s SCOTUS evisceration of the 4th Amendment, they (or we) are liable to be roughed up, arrested, and deported.

He also claims he's worked in the legal profession for 40 years, yet has no idea that the US Constitution protects everyone on US soil, not just US citizens.

All kinds of people are being randomly picked up, attacked, assaulted, detained. Legal immigrants, US citizens, people with no criminal histories whatsoever, anyone and everyone. How do you not know this?? Do you live under a rock? Or maybe just a Fox rock?

You’re also wrong about warrants. The U.S. Constitution protects EVERYONE on US soil. Everyone. Did you fail civics, too?

So "a constitutional and federal court legal technician & paralegal for almost 40 years" hasn't read the Constitution. Fascinating.

And the hundreds of videos exposing criminal ICE behavior must be "propaganda legacy media."

And the testimony of ICE's victims to Congressional committees is "propaganda legacy media."

And the court decisions contradicting Kristi Noem and her band of ghouls and ordering them to stop are "propaganda legacy media."

And ICE's arrests of US citizens, legal immigrants, and people with no criminal records are just "propaganda legacy media."

And Renee Good and Alex Pretti were murdered, no doubt, thanks to "propaganda legacy media."

You say you don't get your news from "ABC, CBS, NBC, CNN, MSNBC, NY Times, Washington Post, et al." or Fox, so where do you get your news? Substack? Pony Express?

These our our NEIGHBORS, Bruce. They have come here to work for a better life because their countries have been interfered with (regime changes, support of civil wars, annexation, assassinations, etc etc etc) by American imperialism for almost two and a half centuries.

People have basic rights regardless if they're citizens or not, and the data is very clear that most of the people that this administration are kidnapped have NO violent criminal history. Be serious, be kind, be human, Bruce. These actions are an affront to neighborlyness, humanity, and to God. The government cannot just kidnap people who it claims are not citizens - they've already taken folks who ARE citizens, some with papers in hand. If we do not stand up for their rights now, they will be coming for us next. Who's to say that they'll believe that you're a citizen, too? We've already seen videos of ICE agents ripping up Hispanic people's papers.

My heart hurts to see them kidnap children as bait, and in my community yesterday they took a family who was driving their kid to the hospital. We have no idea if that kid or family is still alive. No one deserves that, especially not our neighbors. We have a sacred duty to extend our love and protection to them.

You are sorely mistaken and seem rather full of hate so I'm not sure if I could even reach you with reality. America has been interfering with Latin America for two centuries - the coups in Argentina, Brazil, Chile, Ecuador, Venezuela, the funding of Guatemala's 40 year long civil war (not to mention the Iran Contra,) assassination attempts on Castro, Chavez, and countless other Latin American leaders, the banana republic tyranny doled out by United Fruit who was in bed with the US government, etc etc etc. these centuries of imperial Latin American actions have caused their countries to be stuck in poverty and power struggles. The least we can do for them is provide refuge for violence that was funded by the United States.

The vast majority of people the government are kidnapping have never committed any violent crimes. That is verifiable, factual information. They are kidnapping children, mothers, fathers - the government is KIDNAPPING OUR NEIGHBORS and you are content with that just because they have different colored skin than you.

Our ancestors (my great grandma fled genocide enacted by the British) came here when all they had to do was show up at ellis island. They gave them anglicized names, and then just let them in. The immigration process today, after nearly a hundred years of racist and xenophobic policy changes, is completely different and nearly impenetrable. (I have a friend who's husband is a white, English speaking British man, and it's been over two years of him trying to immigrate and they still haven't been able to do so properly. He's here on an expired and legal green card. This is the easiest way to immigrate currently and it's insanely difficult.)

You have betrayed your fellow men, your neighbors, and the loving light of god with your uninformed, hateful, bigoted rhetoric. I hope you do not believe in hell because it's obvious what the fate for those who harm their neighbors will face. I hope one day you can recover your humanity, Bruce. I wish you well, and I wish that your family stays safe and isn't kidnapped by the US government like our neighbors.

You are mistaken to put it kindly. They are only “illegal”—i.e.criminals—if they entered the US AFTER being deported.

In a better America, Timothy Gerber would be subject to sanctions for actively deceiving the court. Meanwhile, Pam Bondi would be subject to sanctions for being an accessory after the fact regarding Renee Good's murder. And of course, Yale grad JD Vance would at least get a hairy eyeball for his legal hot takes amounting to stochastic legal terrorism

If ICE by policy is violating the 4th Amendment and there’s no likelihood of Bivens relief, an injunction seems all the more necessary.

PS kudos to 8th Circuit panel that denied mandamus on arrest warrants.
