I'm not a lawyer, but I'm pretty sure filing a false report is a felony (say, reporting that a prisoner had tried to commit suicide when, I fact, it was a homicide resulting from the actions of his captors). When are we going to start to see arrests and trials?

Sam.'s avatar

We will not. Instead, the Democrats will mutter something about "national unity" and sit on their hands until the next insurrection.

J Thomas's avatar

Probably never. By the time the 2026 election (this is a multiple choice item; take your pick)

A. Takes place

B. Is delayed indefinitely by a presidential declaration of national emergency

C. Voided by presidential declaration that it was fixed to benefit Democrats

D. Rendered meaningless by terrorist, i.e. ICE, Border Patrol, Proud Boys, Oath Keepers, activity around blue precinct voting places

E. Be conducted and counted in a Putin-like manner with the outcome predetermined

the republic will likely be in tatters.

Only when the Democrats regain House and probably Senate majority.

The Kerr analysis is as thoughtful and generous to DHS/ICE as anyone, apart from the Supreme Court, is going to be, and Kerr concludes that the Administration has an argument (that administrative warrants allow home entry, abduction and detention), but that it isn't very sound. We are in this for the long, long haul folks; all of the powers of the state, save for the initial judicial functions of the US federal district courts, are in the hands of predatory and vengeance filled actors, whose willingness to contort the law is only matched by their belief that the Supreme Court which they paid for will eventually come through for them.

Richard Luthmann's avatar

I support deportations. I support ICE. I support President Trump’s agenda. What I do not support is lazy lawyering dressed up as executive power. A deportation order is not a battering ram. It’s an administrative finding. The idea that it magically converts into a Fourth-Amendment-free search warrant is insane — and unnecessary. Federal magistrate judges exist for a reason. If ICE wants to kick a door, get a warrant. It takes hours, not weeks. When the government cuts corners, it loses moral authority, hands wins to activist judges, and risks poisoning otherwise lawful enforcement. You don’t need to break the Constitution to enforce it.

J Thomas's avatar

Trump announced that he and his actions can only be controlled by his own morality. He is amoral. That doesn’t bode well for the future.

Christopher Cole's avatar

Thanks for this post; it is buoying to know that a conservative understands that this excess serves no real American's purpose. Adherence to the rule of law, and the sometimes tedious -- but rights protective -- processes serve every American, every citizen, and every person here on our soil.

Sam.'s avatar

Richard, does this seems like a one-off "oopsie" to you, or is it possible that this is indicative of deeper failures within the administration?

Bruce Eden's avatar

Again, these are ILLEGAL ALIENS that committed felonies by entering the United States illegally. Many being arrested committed additional felony crimes. This creates exigent circumstances where a warrant is not available and the arrest must be made immediately. If you are NOT a citizen, you are NOT entitled to a warrant.

J Thomas's avatar

ICE is making no distinction among undocumented aliens, legal residents, those awaiting or even attending asylum hearings, and citizens. If they look Hispanic, speak Spanish or even English with an accent, work at low paying jobs, or in the vicinity of any of the above, per Kavanaugh’s SCOTUS evisceration of the 4th Amendment, they (or we) are liable to be roughed up, arrested, and deported.

Lisa Simeone's avatar

I notice that Bruce Eden didn't respond to your comment, J Thomas. He claims he wants facts and evidence, yet when they're presented, he ignores them.

He also claims he's worked in the legal profession for 40 years, yet has no idea that the US Constitution protects everyone on US soil, not just US citizens.

Lisa Simeone's avatar

FALSE.

Is it possible that you actually believe the shit you spew?

All kinds of people are being randomly picked up, attacked, assaulted, detained. Legal immigrants, US citizens, people with no criminal histories whatsoever, anyone and everyone. How do you not know this?? Do you live under a rock? Or maybe just a Fox rock?

You’re also wrong about warrants. The U.S. Constitution protects EVERYONE on US soil. Everyone. Did you fail civics, too?

Bruce Eden's avatar

Prove your allegtions with facts. And, don't use ABC, CBS, NBC, CNN, MSNBC, NY Times, Washington Post, et al. as your sources. They are so left-wing biased, that even the old Soviet Dictatorship is blushing. When you resort to name-calling you expose yourself that you don't have a valid, cogent argument and you are shooting from the hip based on emotion, and not facts or law. As a constitutional and federal court legal technician & paralegal for almost 40 years, I would suggest you go do your research. And, by the way, I don't watch FOX News. They've been wrong more than they've been right. Same as the rest of the propaganda legacy media.

Lisa Simeone's avatar

I guess the Irish Time is also not reputable, right?

‘Absolute hell’: Irishman with valid US work permit held by Ice since September

Seamus Culleton has been in a detention facility in Texas for nearly five months despite having no criminal record

https://www.irishtimes.com/world/us/2026/02/09/absolute-hell-irish-man-with-valid-us-work-permit-held-by-ice-since-september/

Lisa Simeone's avatar

So "a constitutional and federal court legal technician & paralegal for almost 40 years" hasn't read the Constitution. Fascinating.

And the hundreds of videos exposing criminal ICE behavior must be "propaganda legacy media."

And the testimony of ICE's victims to Congressional committees is "propaganda legacy media."

And the court decisions contradicting Kristi Noem and her band of ghouls and ordering them to stop are "propaganda legacy media."

And ICE's arrests of US citizens, legal immigrants, and people with no criminal records are just "propaganda legacy media."

And Renee Good and Alex Pretti were murdered, no doubt, thanks to "propaganda legacy media."

You say you don't get your news from "ABC, CBS, NBC, CNN, MSNBC, NY Times, Washington Post, et al." or Fox, so where do you get your news? Substack? Pony Express?

Bruce Eden's avatar

I guess you're the quintessential Trump Derangement Syndrome Left-wing Demoncrat Communist troll; n'est-ce pas.

These our our NEIGHBORS, Bruce. They have come here to work for a better life because their countries have been interfered with (regime changes, support of civil wars, annexation, assassinations, etc etc etc) by American imperialism for almost two and a half centuries.

People have basic rights regardless if they're citizens or not, and the data is very clear that most of the people that this administration are kidnapped have NO violent criminal history. Be serious, be kind, be human, Bruce. These actions are an affront to neighborlyness, humanity, and to God. The government cannot just kidnap people who it claims are not citizens - they've already taken folks who ARE citizens, some with papers in hand. If we do not stand up for their rights now, they will be coming for us next. Who's to say that they'll believe that you're a citizen, too? We've already seen videos of ICE agents ripping up Hispanic people's papers.

My heart hurts to see them kidnap children as bait, and in my community yesterday they took a family who was driving their kid to the hospital. We have no idea if that kid or family is still alive. No one deserves that, especially not our neighbors. We have a sacred duty to extend our love and protection to them.

“ALIENS are stealing our tax monies that would go to REAL Americans that need rural hospitals, health care, and better education systems.” Are you kidding? Trump and his cult in Congress are withholding the monies about which you write.

Bruce Eden's avatar

Wrong! They are here ILLEGALLY. They are ILLEGAL ALIENS. They are not citizens. They didn't go through the citizenship process like LEGAL ALIENS do. They didn't have a job when they came here like LEGAL ALIENS do. They didn't have sponsors and a place to live like LEGAL ALIENS do. They are NOT our neighbors. They've defrauded us Americans out of our tax monies that could have gone to our real neighbors, who are suffering economically thanks to the last Administration. Instead they sent TENS OF BILLIONS OF DOLLARS of stolen tax money to their home country to be used by terrorist groups. The ILLEGAL ALIENS are stealing our tax monies that would go to REAL Americans that need rural hospitals, health care, and better education systems. They defrauded real Americans out of tax monies that could go to our own children to give them a better future. No. It isn't about American imperialism. Whoever taught you that in High School or College is full of shit. They are Communist liars looking to undermine this country.

When you have enough ILLEGAL ALIENS in this country to undermine this country and turn it into a Communist dictatorship like Cuba, Venezuela, North Korea, Iran, or even Communist China where you have no First Amendment Rights, or any other rights, what country do you go to then to find Freedom and have all the things we do????? Hmmmm?????

My grandparents came to the United States after fleeing fascism in Europe in the 1930s. They had sponsors, they had a job, they had a place to live. They were the real immigrants seeking ASYLUM from the likes of Adolf Hitler and Benito Mussolini. But, they had to go through the LEGAL immigration process. They had to go through Ellis Island, New York in order to step foot in the United States. They were tested for diseases (smallpox was the rage back then). They were tested to see if they could speak English. They had to prove they had a job, place to say, a sponsor. They had to prove who they were. They were held for days and weeks before being processed and to make sure they were disease-free. They didn't come and jump on welfare, get free healthcare, free schooling, free housing, free cash right away. There was no welfare system when my grandparents came here. They had to work, or die.

So, no. The current crop of ILLEGAL ALIENS are not our friends and neighbors. They've come here to steal from us, defraud us, make us sick with their diseases which we've pretty much eradicated over the past 100 years. They've come here to KILL US by virtue of the women, children and men they've murdered with drugs, guns, kidnapping, human and child trafficking, torture and rape. They've murdered HUNDREDS OF THOUSANDS OF REAL AMERICANS!!!!! So, NO, ILLEGAL ALIENS have NO RIGHTS!!!!!!!!!

Sol ☀️ (He/They)'s avatar

You are sorely mistaken and seem rather full of hate so I'm not sure if I could even reach you with reality. America has been interfering with Latin America for two centuries - the coups in Argentina, Brazil, Chile, Ecuador, Venezuela, the funding of Guatemala's 40 year long civil war (not to mention the Iran Contra,) assassination attempts on Castro, Chavez, and countless other Latin American leaders, the banana republic tyranny doled out by United Fruit who was in bed with the US government, etc etc etc. these centuries of imperial Latin American actions have caused their countries to be stuck in poverty and power struggles. The least we can do for them is provide refuge for violence that was funded by the United States.

The vast majority of people the government are kidnapping have never committed any violent crimes. That is verifiable, factual information. They are kidnapping children, mothers, fathers - the government is KIDNAPPING OUR NEIGHBORS and you are content with that just because they have different colored skin than you.

Our ancestors (my great grandma fled genocide enacted by the British) came here when all they had to do was show up at ellis island. They gave them anglicized names, and then just let them in. The immigration process today, after nearly a hundred years of racist and xenophobic policy changes, is completely different and nearly impenetrable. (I have a friend who's husband is a white, English speaking British man, and it's been over two years of him trying to immigrate and they still haven't been able to do so properly. He's here on an expired and legal green card. This is the easiest way to immigrate currently and it's insanely difficult.)

You have betrayed your fellow men, your neighbors, and the loving light of god with your uninformed, hateful, bigoted rhetoric. I hope you do not believe in hell because it's obvious what the fate for those who harm their neighbors will face. I hope one day you can recover your humanity, Bruce. I wish you well, and I wish that your family stays safe and isn't kidnapped by the US government like our neighbors.

Another personal ad hominem attack from a Liberal Leftist. How come when you can't argue your points, you Leftist-Democrat-Communists resort to name-calling. I didn't call you names. So, therefore, I know that if I'm being personally attacked with your vitriol, I know that I'm over target and I'm in the RIGHT.

Once again, if you're an ILLEGAL ALIEN that has stepped foot into this country illegally and have not been processed you've committed a crime under United States law, 8 U.S.C. §1325. Punishment is 6 months in jail and deportation. If that doesn't define crime, then I can't help you figure it out. Many of those deported are real criminals that are murdering, raping, sexually abusing children, perpetrating frauds against American taxpayers, stealing money from people, assaulting people, etc. I never heard you or anyone else be this vehement against Democrat Presidents who deported illegal aliens. Barack Obama deported 10 MILLION illegal aliens. Not one peep from the bleeding heart Leftist-Communists. Bill Clinton deported over 5 MILLION illegal aliens. Not one peep from the bleeding heart Leftist-Communists. President Trump deports over 2 Million ILLEGAL ALIENS in a year, and ever Leftist-Communist is shi**ing in their pants over it. That tells me you Leftist-Communist are full of sh*t and lying about it and trying to gaslight the public.

You are mistaken to put it kindly. They are only “illegal”—i.e.criminals—if they entered the US AFTER being deported.

Bruce Eden's avatar

In the United States, illegal immigration is a federal offense under 8 U.S.C. § 1325. The maximum punishment, six months' prison term for the first offense. After that, it becomes a FELONY, especially if deported and come back into the United States.

Joeff's avatar

First time unauthorized entry is a misdemeanor. Overstaying a visa is not.

"Mazzara was most recently in the news for acknowledging that he was the person who gave DHS Secretary Kristi Noem legal advice about whether or not to turn around the Alien Enemies Act flights the night of March 15 after Chief Judge James Boasberg ordered the administration to do so. (They did not turn the flights around.)"

I forget, was this one of the freaks who was threatened with but never received significant professional penalties for his illegal actions?

Tim Tucci's avatar

In a better America, Timothy Gerber would be subject to sanctions for actively deceiving the court. Meanwhile, Pam Bondi would be subject to sanctions for being an accessory after the fact regarding Renee Good's murder. And of course, Yale grad JD Vance would at least get a hairy eyeball for his legal hot takes amounting to stochastic legal terrorism

If ICE by policy is violating the 4th Amendment and there’s no likelihood of Bivens relief, an injunction seems all the more necessary.

PS kudos to 8th Circuit panel that denied mandamus on arrest warrants.

Bruce Eden's avatar

I would agree with you wholeheartedly about the Fourth Amendment Warrant Clause--if it were for REAL Americans. These are ILLEGAL ALIENS that committed a crime the instant they stepped foot on to American soil without the proper process and documents. Then there are those ILLEGAL ALIENS that not only committed the crime of illegal immigration, but child sex abuse, murder, assault, drug trafficking, human trafficking, child trafficking, and a myriad of other felonies. These situations are exigent circumstances NOT REQUIRING a warrant.
