Glad to see the Trade court finally ruled that Cheetolini’s illegal and idiotic tariffs are unconstitutional. It’ll be interesting to see how slow and incompetent the administration will be in refunding the illegally collected tariffs.

I have precisely zero expectation that the zombie army, Senate division, will reject Bove. Who knows, he might even pick up a Dem or 2. This vacancy exists because 3 Dems voted against Biden’s nominee, a Muslim.

Bove is reportedly being nominated for a Third Circuit slot.

Many people assume it is for the one for which Adeel A. Mangi was nominated. He was the Muslim judicial nominee whom two Democratic senators opposed, thus blocking him. However, there are two vacancies on the circuit. One is a recent vacancy involving a Republican nominated judge.

[ETA: Manchin also opposed it. He had a policy near the end of not confirming when no Republican voted for someone. No Republicans supported Mangi. They also have agency.]

I have not seen specificity on what slot Trump is filling. Overall, I am still mad that Democrats left over 30 judicial vacancies (mostly district courts, but still) for Trump to fill.

The Dems left vacancies bc Durbin refused to shitcan the blue slip. Let’s see how that holds up with the zombie army in charge. They also sacrificed appellate nominations to get more district judges through.

There's no slot to fill. If there are two vacancies Donald Trump can make two nominations. They won't go into any slot.

The official nomination cites a specific vacancy that is being filled. It isn't "for the Third Circuit." It is for a specific vacancy. The Third Circuit judges also have specific duty slots.

For instance, one Biden nomination: "Tiffany P. Cunningham, of Illinois, to be United States Circuit Judge for the Federal Circuit, vice Evan Jonathan Wallach, retiring."

I stand corrected. I did not know that was the practice. But does it matter which slot Emil Bove is nominated for? In other words, is Donald Trump constrained in any way as to who he nominates to fill any vacancy? And will a new judge's duty slot depend on Donald Trump's choice of slot?

Let's not move the goalposts here: The fact that Bove is *extremely* unqualified does not make Bork qualified.

You're right. Robert Bork's qualifications have nothing to do with Emil Bove's.

Emil Bove's nomination is like Matt Gaetz's nomination for attorney general. Emil Bove has no experience or talent for the job of appeals court judge. It's not a question of his views on the law -- whether he is liberal or conservative. It's basic competence, or in his case, incompetence.

This will be a good test of Republican senators. If they confirm Emil Bove to be an appeals court judge, they have lost any credibility.

Robert Bork, on the other hand, was a brilliant legal scholar and judge. He was more qualified than anyone on the Supreme Court today. His book The Antitrust Paradox reshaped antitrust law for generations. Just the other day I used his quote about the IBM case being the Antitrust Division's Vietnam. He is still relevant years after his failed nomination.

Robert Bork was borked because the Democrats controlled the Senate and decided to use that power politically. Joe Biden was the senator who as chairman made the hearings a disgrace. Robert Bork's nomination was rejected because of his conservative views and gruff persona, not because he was incompetent.

Honestly I don’t remember the details of the bork nomination (it happened when I was but a child)…just that he was very controversial and the right has been big mad since his nomination was sunk.

Feels like we are either in a house of cards falling moment …perhaps with the court rulings, the Republicans pushing back a bit on Russia /Ukraine, maybe, maybe above being a bit too far for the Senate Judiciary Committee???…or the Regime/Miller, Vance, Voight will go full throttle authoritarian and defy the courts and, essentially, unconvene Congress.

The problem I see is there are countless instances over the last nine years when we could say, 'This is a line that cannot be crossed', and in a great many of them said line was crossed. So I think we're forced in every situation to ask, 'What happens (next) when this line is crossed?'

With Trump and the republicans it’s all about furthering corruption and dismantling the Constitution, law and democracy for autocracy. Never has government corruption been so obvious and out in the open for all (including our nations enemies) to witness and take full advantage of at the danger to our nations and citizens safety all to enrich and further empower the felon at the top.
