Chris, I’m interested in why you think Aileen Cannon backed down on this, if in fact that’s the correct interpretation of this. I read her order early on Monday and it seems that way to me but my experience with how such orders are phrased is limited. I wondered if she was swatted down behind the scenes, given how far she over reached on the part of the report involving a case over which she had no jurisdiction.
Honestly, I think the answer is just sometimes too far is too far. It doesn't change the fact that she never should have issued the order at all or the fact that she still says she's blocking the classified documents case (and DOJ is apparently going along with it).
Chris, thank you so much for your initial thoughts. I have two questions:
1. Why can’t Biden do anything to release Volume 1 on the documents case? He certainly can override a federal judge, with no jurisdiction, as it concerns national security and dismiss the two parties and get the report out. Why isn’t that an option?
2. I feel so passionately about the immunity ruling, the impact, essentially the same as “the hush money” election interference case, in keeping information from the voters by deliberately delaying the ruling, so people voted blindly, to a degree it made a difference. The imminent outcome was known to Roberts in time to get this to trial, that I feel, he should be impeached. Could it cause immense backlash… yes. But does that enter into sane rational discussion about his leaked docs about this deliberate delay and the pushback we need to begin to the Fear Mongers who, of course, won’t impeach but it’s time to do take action if we ever are too. They aided and abetted criminal activity before their ruling. I’m really angry!

It is rather likely that the two remaining minor prosecutions involving classified documents will be dropped soon by the Trump Justice Department. Not releasing Jack Smith's report regarding that prosecution based on pending prosecutions is technically reasonable but realistically it will likely lead to the report being stuffed. The two minor prosecutions, to suggest something noted on the Strict Scrutiny Podcast recently, should have been dropped and the report released. On their own, without the Trump prosecution, the minor prosecutions aren't that important.
Correct assumption Joe, the do-defendants cases are likely to be trashed when Trump takes office, charges could be dropped and the investigation volume of the documents Trump sold,hoarded, or traded for future favors from foreign countries could be released today! I’ve called and written my senators, congressman and Garland’s office multiple times, everyone should. The truth lies in the facts that “We the Serfs” are legally entitled to peruse!!

Question that was posed to me that I can't answer: can this case be reopened in the future? So after this term has ended? Or if he is impeached or forced to resign?
I’m not clear as to why the two “minor prosecutions” are being dropped unless as examples of “obeying in advance”. Maybe they do not provide the same impact as prosecuting the former president, but they can provide substance to the original charges. Now the narrative will likely be that there were charges about actions of the former president but that they were all dropped. As if the charges were not substantive.
The prosecution of Nauta and Olivera have not been dropped. As soon as Pam Bondi (or similar) takes over DOJ she’ll order them dropped and she won’t release the Volume I report about the stolen documents. The one argument for dropping those two prosecutions now are that then DOJ could release that volume also to be public before Jan 20 and the obstruction of justice and rampant corruption begins at DOJ
