It continues to mystify me that the Democratic appointees on the DC Circuit, over and over, allow their rules to be abused and manipulated by the Trumpies. The original mandamus petition in this case should have been denied in a matter of days, not months.

Any so-called "administrative stay" should be limited to one week, and any grant of a full stay should be automatically subject to en banc reconsideration. I realize this would amount to schoolmarmish behavior if you were dealing with actual judges but you're dealing with partisan hacks who have forfeited any right to be treated as though they were adjudicating cases in good faith.

Writs of mandamus aren't common and here the panel has issued two in a row on this case. Successful appeals of contempt matters are also uncommon because judges have wide latitude in how they govern conduct in their own courtrooms.

This ruling, therefore, cries out for en banc review and the DC Circuit would be wise not to shrink from that responsibilty this time.

So it’s NOT the same panel but it’s STILL 2-1! Admittedly it’s only an admin stay but JFC when does this end? Hopefully the SEVEN Dems Get their sh*t together and take charge like they should have done from the git-go.

Did Rao and Kastas basically play the full DC circuit for fools? Now that there is an administrative stay in place, isn't Boasberg's contempt inquiry effectively dead? They will sit on this forever.

The Dems on the circuit have repeatedly allowed themselves to be played for fools. The original mandamus petition should have been taken en banc and summarily denied in two sentences, as the vast majority of mandamus petitions are. Let the Trumpies write their fascist screeds for as long as they want to, but it should not be holding up resolution of the underlying case.

It's profoundly mystifying why the Dems continue to behave so lamely.

These aren’t “Republican failures,” they are Republican successes at protecting their own through partisan misuse of the law. Dems have showed no spine in tolerating this. If we win a majority in Congress, there needs to be a major reckoning.

What do you expect the Democratic-appointed judges to do: Burn down the court houses? Craft voodoo dolls and stick pens into them on X?

They vote against the action and they write a dissent. They're not Emil Bove who regularly trashes what it means to be a judge.
