Tuesday's SCOTUS arguments will be a first sign of the court we're dealing with this term. Also: Louisiana redistricting. And: Florida has an execution set for Tuesday.
I wonder how influential the rebarbative James Ho is, sitting on the 5th CA, as he seems forever included on various three-judge panels who issue off-the-wall relief from district-court opinions, injunctions, etc. The man is a loose cannon, and the egregiousness of his opinions seems to carry some weight amongst his colleagues, does it not? Maybe I'm missing something, but has he ever written a principal opinion, or only a concurring one?
I mean, if he's only concurring, that would suggest *less* influence. I don't know, though. I think most of them probably think he's out there, but, if I were try to get inside the minds of the Fifth Circuit, I might never return. (But, factually, sure he's written main opinions. Appeals courts hear a lot!)
There are no trans care cases at SCOTUS now, even in terms of a request. We'll have to see what the plaintiffs in the TN and KY cases choose to do now. They might seek en banc review from the full Sixth Circuit, like is happening in the Alabama case and the Eleventh Circuit.
