Fortunately, appellate courts must leave the lower court’s findings of fact undisturbed. It will be difficult for higher courts to disregard all the facts laid out by the trial judge and rule a different way. To do so, they’ll have to engage in fantasy and hypotheticals that aren’t borne out by the facts.
